THIS WARRANTY DOES NOT AFFECT YOUR STATUTORY RIGHTS
Your Happy Plugs-branded hardware product is warranted against defects in materials and workmanship for a period of ONE (1) YEAR from the date of original retail purchase (“Warranty Period”). If a defect arises during the Warranty Period, Happy Plugs, at its option and to the extent permitted by law will (1) exchange the product with a functionally equivalent product that is new or equivalent to new in performance and reliability, or (2) refund the original purchase price. This warranty excludes damage resulting from abuse, accident, modifications or other causes that are not defects in materials and workmanship.
To the extent permitted by applicable law Happy Plugs is not liable for any direct, indirect, incidental or consequential damages arising out of the use or service of the product. The warranty and remedies described above are exclusive and in lieu of all other warranties, remedies, and conditions, whether oral, written, express, statutory or implied. To the extent permitted by applicable law Happy Plugs disclaims all implied and statutory warranties, including, warranties of merchantability and fitness for a particular purpose. If implied warranties cannot be disclaimed, then such warranties are limited in duration to the duration of this warranty.
Any recovery is limited to the original purchase price. No other person is authorized to modify this limited warranty, and your seller is solely responsible for any other warranties.
Some states do not allow limitations on how long an implied warranty lasts, or allow exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. After receiving your warranty claim we will get back to you and help you with your claim. You must however bear any costs of delivery or other expense incurred in making your claim.
Notice to Australian Consumers
The rights described in this warranty are in addition to the statutory rights to which you may be entitled under the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Repair of the goods may result in loss of data. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
Notice to New Zealand Consumers
Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. This warranty should not be construed as any attempt to contract out of or exclude any or the guarantees available to any consumers under this Act provided that you agree that the provisions of the Consumer Guarantees Act 1993 will not apply if you are acquiring the goods for the purpose of a business.
